Medical Marijuana and Child Custody

What is the impact of medical marijuana in a custody case?  With Pennsylvania legalizing marijuana for certain medicinal purposes, questions arrive how a parent’s use of medical marijuana will impact the Court’s award of custody.  In a recent case the Superior Court held that a parent’s use of marijuana, even if legally prescribed, may be taken into consideration by the Court in making a decision on the best interests of the children.  It is important to note that those parents who had a medical marijuana card also had a history of illicit drug use and poor parental choices.
