The families of four Delaware County residents who died of Coronavirus in 2020 filed suit against the Broomall Rehabilitation and Nursing Center this week, alleging negligence and wrongful death.
The four families are seeking compensatory and punitive damages from the nursing home and individuals working there. Defendants include: Broomall Operating Company LP, Broomall Operating GP LLC, SavaSeniorCare LLC, Terpax Inc. and five people named simply as “John Does.”
The facility is accused of failing to meet the needs of residents, with “recklessly high” resident-to-staff and resident-to-nurse levels.
Severe staffing shortages during the early stages of the Coronavirus pandemic brought the National Guard to the facility, with 12 Army medics and six Air Force nurses deployed there on April 18, 2020. Five days later, 88 residents and 26 workers at Broomall had Covid, and 17 residents had died from the virus. Within a month, 155 residents had Covid and 43 had died from the virus.
A state Department of Health facility inspection observed multiple poor infection prevention procedures by workers, included failures to put on clean gloves upon entry into residents’ rooms and failure to use appropriate face masks and gowns while nearby to infected residents. The PA Department of Health found the facility to be non-compliant to state infection prevention and issued a deficiency report on June 1.
