What is the RICO Act?

The Racketeer Corrupt Organizations Act (“RICO”) is a federal statute that allows a party to obtain triple damages plus attorney fees if the party prevails on certain categories of business torts and fraud claims. 

An Eckell Sparks client was accused in federal court of numerous causes of action in which the Plaintiff asserted the right to RICO damages, but Eckell Sparks counsel Pat Henigan obtained dismissal of all RICO claims, which sought damages in excess of $4 Million. While the client may still be found liable for breach of contract damages, the threat of punitive RICO damages has been removed.
